In the Commonwealth of Pennsylvania the severity of a DUI charge depends on how much alcohol is determined to be in the blood stream of a driver according to a ratio called the Blood Alcohol Concentration (BAC).  The higher a person’s BAC, the higher the penalties potentially imposed by the Court.

The Commonwealth of Pennsylvania has established three tiers of driver impairment based on the BAC.

  1. GENERAL IMPAIRMENT

Criteria

  • BAC between .08 and .099%
  • No property damage or injury
  • Driver is at least 21 years of age

Penalties

  • Up to six months probation
  • A fine of $300
  1. HIGH IMPAIRMENT

Criteria

  • BAC between .10 and 0.159%
  • General BAC with an accident or injury
  • General BAC if driver is under 21
  • School Bus Driver with BAC between .02% and  0.159%
  • Commercial Vehicle with BAC between .04 and 0.159%

Penalties

  • Prison sentence of between two days and six months
  • License suspension for 12 months
  • Fines between $500 and $5,000
  1. HIGHEST IMPAIRMENT         

Criteria

  • BAC of .16% or higher
  • Refusal to take a chemical test
  • DUI Drugs

Penalties

  • Prison sentence of a minimum of three days to a maximum of six months
  • License suspension for 12 months
  • Fines between $1,000 and $5,000
